After any revisions to our Legal Terms are posted, you agree to be bound to any such changes to them. Therefore, it is important for you to periodically review our Legal Terms to make sure you still agree to them. The effective date will be displayed at the bottom of this Terms & Conditions page.
By using our Website and our services, you agree to fully comply with and be bound by our Legal Terms. Please review them carefully. If you do not accept our Legal Terms, do not access and use our Website and services. If you have already accessed our Website and services and do not accept our Legal Terms, you should immediately discontinue use of same.
In order to help navigation, this document is divided into the following sections:
Section 1 – Definitions & Acceptance of Terms
- You or Your means you as a Student, participant in or as a user of The Design Ecademy’s websites and other services
- We or Our or Us means The Design Ecademy Ltd
- TDE means The Design Ecademy Ltd
- OLS means the Online Learning Studio
The Design Ecademy Limited is registered in England & Wales, Company Number 11125753
The Design Ecademy have a full-time administration and Student Support Team based in the UK. They are available by phone from Monday to Friday 9am – 5pm GMT
Our offices close for all public holidays in the UK and for short durations during key holiday periods (such as Christmas). When we plan to close our offices for holidays we will notify students by posting notice on the Online Learning Studio at least 2 weeks prior to the planned closure.
ACCEPTANCE OF TERMS:
By accessing, downloading, installing, or using The Design Ecademy services, whether or not you become a registered student or user (“Student”, “User”, “You”, “Yourself”, “Your”), You agree to be bound by these Terms, which You acknowledge that You have read and understood.
We reserve the right, at Our sole discretion, to change, modify or otherwise alter these Terms at any time. You must review these Terms at http://www.thedesignecademy.com/terms-conditions-of-enrolment/ on a regular basis to keep Yourself informed of any changes.
Section 2 – Fees, Cancellation, Money-Back Guarantee & Refunds
We hope that you will absolutely love our courses, products and services! However, you’re fully protected by a 100% money-back guarantee as follows:
Full 14 Day Refund Policy – If you are dissatisfied at any time during the first 14 days after your enrolment on a course, simply return all physical products we may have shipped to you, delete all digital video, audio, and text files you may have obtained from us, and ask for a refund. You will get your money back. That’s a firm promise and commitment.
NB: Please note that the 14-day full money-back guarantee is only applicable to students enrolling on a self-paced online course. Students enrolling on a scheduled course must pay the fees in full and are not entitled to a refund. Additionally, the 14-day refund period applies from the date of enrolment in all cases, including those times when students choose to defer the start date of their course. There is also no refund for the following:
- Orders or purchases of an Extension or Restart from existing students
- Resubmission Fees
- Transcript fees, official letters or any other ad-hoc administration fees
Full Money-back “Guarantee of Skills & Knowledge” you will achieve on our courses – Unlike other colleges, we don’t just assure you of what we teach; each course prospectus accurately represents the distinctive skills and knowledge that you will learn and/or achieve when you successfully complete a particular course. All our courses are designed to give you the real skills and knowledge you need to work in the industry at a professional level. Therefore, we guarantee that when you successfully complete a course you will achieve the skills and knowledge as we have described in the relevant course prospectus. If you do NOT gain the practical skills and knowledge that we have described, then we’ll refund your course fees in full AND you’ll still keep your award. To avail of this money-back guarantee, the Student must demonstrate unequivocally how their work fails to demonstrate the skills and knowledge described in the prospectus published at the time of their enrolment.
Payment of Fees – Following the acceptance of an enrolment by The Design Ecademy and once the 14-day refund period has passed, you will be contractually bound to pay the full amount of the fees in the manner set out in the enrolment form at the time of your enrolment. After 14 days have passed from the date of enrolment, you will not be entitled to a refund in respect of fees paid (except in the instance of You invoking the guarantee of Skills & Knowledge previously described in section 2). Furthermore, you will be required to make all the payments contained within Your instalment plan.
If you choose to make payments in instalments, where any fee or part of a fee remains unpaid 14 days after the due date, The Design Ecademy reserves the right to:
- charge interest on the overdue amount at the rate of 15% per annum from the due date until actual payment; and/or
- cease supplying any course materials and tuition services to You without prejudice to the obligation to pay fees; and/or
- demand payment in full of all fees and instalments outstanding.
The Design Ecademy will cancel Your student registration with no recourse to a refund if at any time tuition fee payments fall three calendar months or more in arrears.
You understand that fees may not be transferred to another course or to another individual. Notwithstanding the aforementioned, any transfer of fees is at the sole discretion of The Design Ecademy and will not be deemed to constitute a precedent.
When enrolling on a course you are required to accept these Terms and Conditions whereupon you enter into a legally binding contract. You are not entitled to cancel this Contract in any circumstances other than as set out in this document. You agree to pay any and all legal fees incurred by TDE as a result of enforcing this contract. Furthermore, no failure or delay by TDE in enforcing any of its rights under these Terms and Conditions shall be deemed to be a waiver of such right. If any provisions of these Terms and Conditions are held to be unenforceable, illegal or void in whole or in part the remaining portions of the Terms and Conditions shall remain in full force and effect
Where applicable, The Design Ecademy will charge extra tuition fees, known as extension fees, to cover rising costs if the study period exceeds the time scale detailed in the course description at the time of enrolment. Details of those fees can be found in the Student Handbook which will be provided to you upon enrolment.
Discount Codes, Refunds & Cancellation – When upgrading from an Introduction Course to an accredited professional course (such as a Professional Certificate, HNC or HND) a discount code may be provided for the original amount paid for the introduction course. Students must request a discount code prior to upgrading in order to avail of the advertised refund.
Any discount codes must be applied to course fees at the time of enrolment. Discount codes cannot be applied retrospectively or used to claim a refund for the discount amount at a future date. Notwithstanding the aforementioned any repayment of paid fees is at the sole discretion of The Design Ecademy and will not be deemed to constitute a precedent
Please submit all cancellation and refund requests by e-mail to [email protected]. Make sure to clearly state for which course or product you are requesting a refund and include your full name and email address and any other codes/user names that we may have provided (such as the Unique Student ID).
To serve you and others better in the future, we will ask you to complete a short questionnaire to let us know why you want a refund. We have included this process simply so that we can find out how we can improve and make sure we have very satisfied customers.
Please remember that asking for a refund but continuing to use any course materials provided by us is the same thing as stealing and may also violate applicable intellectual property rights law.
We reserve the right to cancel a course at any time subject to repayment of any fees received in respect of the course or the part of the course that has been cancelled.
Section 3 – Intellectual Property
You agree that all materials provided by The Design Ecademy remain the property of The Design Ecademy and are provided to You on the understanding that they may not be lent, hired, sold, copied or otherwise transferred to another individual (including other students) without prior written permission from us. You understand that copyright and all other intellectual property rights in all course materials belong to TDE and You agree not to modify, distribute, or create derivative works based on the TDE materials in any manner, and you shall not exploit the TDE brand in any unauthorized way whatsoever, including, but not limited to, by trespass or burdening network capacity.
Notwithstanding any other provision of this Agreement, TDE and its licensors reserve the right to change, suspend, remove, or disable access to any TDE products, content, or other materials comprising a part of the TDE brand at any time without notice. In no event will TDE be liable for making these changes. TDE may also impose limits on the use of or access to certain features or portions of TDE services, in any case and without notice or liability.
All copyrights in and to The Design Ecademy (including the compilation of content, postings, links to other Internet resources, and descriptions of those resources) and related software are owned by The Design Ecademy and/or its licensors, who reserve all their rights in law and equity. The use of the software or any part of The Design Ecademy, except for use of The Design Ecademy as permitted in this agreement, is strictly prohibited and infringes on the intellectual property rights of other and may subject you to civil and criminal penalties, including possible monetary damages, for copyright and infringement.
The Design Ecademy, The Design Ecademy logo, other TDE trademarks, service marks, graphics, and logos are trademarks or registered trademarks of The Design Ecademy Ltd. in the UK, the USA and/or other countries. Other trademarks, service marks, graphics, and logos used in connection with The Design Ecademy Services may be the trademarks of their respective owners. You are granted no right or license with respect to any of the aforesaid trademarks and any use of such trademarks.
Section 4 – Academic Policy
There are no previous qualifications or experience required to enrol on one of our courses, except for the ability to read and write English clearly. Notwithstanding this, TDE reserves the right not to approve or accept Your enrolment/course application if we do not believe that you are an appropriate candidate for our course. Furthermore, TDE reserves the right to cancel Your course at any point (subject to the condition of course fees being repaid to You) should we wish to do so.
TDE will provide You with a Student Handbook upon enrolment. The Student Handbook contains the current rules and regulations in relation to the course and provides guidance for You on how to get the best results from the course you have enrolled on. You must read the Student Handbook carefully before commencing the course and You agree to comply with the rules and regulations set out therein.
Coursework, Plagiarism & Malpractice – You will only submit original work and You will not submit work that has not been created by You (either written, drawn or generated by computer) without due acknowledgement of same. If You fail to comply with the foregoing, You accept that You may be prevented from continuing the course without refund of fees, subject to the standard Appeals Procedure in place with TDE.
Deliberately submitting work for a project or for an examination that is not Your own or deliberately submitting work that is copied from another individual or deliberately submitting work that has also been used by another student are considered to be forms of Student Malpractice. If You are found to be guilty of Student Malpractice You will be prevented from continuing the course and the award will be withheld without the option to appeal. You must read TDE’s published Malpractice Policy carefully and You agree to comply with the rules and regulations set out therein.
If You receive a passing grade for any course assignment or major project, You shall not be entitled to re submit it for any reason, (subject to the standard Appeals Procedure) in place with TDE. TDE shall be entitled to charge You a nominal handling fee on each occasion on which we have to mark any item of course-work more than twice.
You will grant to TDE in respect of any work produced by You during the course, a perpetual royalty-free licence to copy, use, exhibit, reproduce or publish any such work for any purposes deemed fit by TDE. Furthermore, You will indemnify and keep TDE indemnified against any loss or damage arising from the breach of intellectual property rights in relation to the foregoing obligations.
Progression – You accept that if You enrol on a progressive course of study (such as Higher National Diploma and Degree programs), You must meet the minimum grade requirements specified in order to continue Your program of study. You accept that failure to achieve the minimum grade requirements will prevent You from continuing the program of study without refund of fees paid in advance, where applicable. Furthermore, TDE reserves the right not to issue You with an award and/or certificate if You fail to achieve the required standard(s). Where applicable, all grading criteria are explained at length in the Student Handbook.
TDE reserves the right without prior notice to make changes as deemed appropriate in course offerings, curricula, academic policies, and other rules and regulations affecting students and to substitute any tutor/lecturer at any time. Furthermore, TDE reserves the right without prior notice to change, modify or disassociate from any current accrediting agency or institution. This does not infringe your rights under the guarantees provided.
Access to Materials – Course materials are released at the appropriate time as you progress through the course. You will only have access to the relevant course materials depending on the stage You have reached on a course. You will not be entitled to access protected course materials unless you have successfully completed the course up to that stage.
As an accommodation to You, once you become an enrolled Student of The Design Ecademy you may download training materials (when available) onto any Associated Device. Some TDE training or services that you previously acquired may not be available for subsequent download or access at any given time, and TDE shall have no liability to you in such event. As you may not be able to subsequently download certain previously-acquired content or training, once you download an item, it is your responsibility not to lose, destroy, or damage it, and you may want to back it up.
The Design Ecademy reserves the right to change content options (including eligibility for particular features) or remove access without notice to any previously purchased training or content that is no longer valid or deemed out of date.
Section 5 – Earnings & Income Disclaimer
TDE can not and does not make any guarantees about your ability to get results or earn any money with our courses, qualifications, information, tools, or strategies. What we can guarantee is your satisfaction with our training (see guarantee section 2). You should know that all materials and services offered by TDE are for educational and informational purposes only. Nothing on this page, any of our websites, or any of our content or curriculum is a promise or guarantee of results or future earnings, and we do not offer any legal, medical, tax or other professional advice. Any financial numbers referenced here, or on any of our sites, are illustrative of concepts only and should not be considered average earnings, exact earnings, or promises for actual or future performance. Use caution and always consult your accountant, lawyer or professional advisor before acting on this or any information related to a lifestyle change or your business or finances. You alone are responsible and accountable for your decisions, actions and results in life and by your registration here you agree not to attempt to hold us liable for your decisions, actions or results, at any time, under any circumstance.
Section 6 – limitation of liability
The Design Ecademy Ltd and its affiliates, shall not be liable for any loss, injury, claim, liability, or damage of any kind resulting in any way from (a) any errors in or omissions from our Website and services; (b) the unavailability or interruption of our Website and services; (c) your use of our Website and services; or (d) any delay or failure in performance of our Website and services.
The Design Ecademy Ltd and its affiliates are not liable for the acts, errors, omissions, representations, warranties, breaches or negligence or for any personal injuries, death, property damage or other damages or expenses resulting therefrom. TDE and its affiliates have no liability and will make no warranty, refund, or other restitution to you with regards to our website and services, other than as specified herein, for any reason, including but not limited to delays, cancellations, strikes, governmental issues or Force Majeure.
In no event will TDE or its directors, employees or agents be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including for any losses arising from your use of our materials and services, even if TDE is aware or has been advised of the possibility of such damages. Notwithstanding anything to the contrary contained herein, TDE’s liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to your ceasing use of our websites and services.
The Online Learning Studio, the Websites and all content and software associated therewith, or any other features or functionalities associated with The Design Ecademy and the Online Learning Studio are provided “AS IS” and “AS AVAILABLE” with all faults and without warranty of any kind. The Design Ecademy does not guarantee, represent or warrant that your use of the Online Learning Studio and our websites will be uninterrupted or error-free.
The Design Ecademy is not responsible for any problems or technical malfunction of any network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or redemption to be received by TDE on account of technical problems or traffic congestion online or on the Internet or at any Website, or any combination thereof including any injury or damage to customer’s or any other person’s computer related to or resulting from downloading or streaming any materials consistent with this agreement or subsequent use of any TDE owned web properties. If, for any reason, streamed materials are not capable of running online as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of The Design Ecademy which threatens or corrupts or adversely affects the administration, security, fairness, integrity or proper conduct of a live stream offer, The Design Ecademy, reserves the right, in its sole discretion, to cancel, terminate or suspend the offer and/or any subscription. Any attempt by you to deliberately damage any website or undermine the legitimate operation of this offer may be a violation of criminal and civil laws and should such an attempt be made, The Design Ecademy will disqualify your attempted redemption and reserves the right to seek damages from you to the fullest extent permitted by the Law.
Our Legal Terms shall be governed by and construed in accordance with the Laws of England, Scotland and Wales without regard to conflict of law principles. In addition, you agree to submit to the personal jurisdiction and venue of such courts. Any cause of action by you with respect to our Websites and/or services, must be instituted within one (1) year after the cause of action arose or be forever waived and barred. Should any part of our Legal Terms be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect. To the extent that any Content in our Website conflicts or is inconsistent with our Legal Terms, our Legal Terms shall take precedence. Our failure to enforce any provision of our Legal Terms shall not be deemed a waiver of such provision nor of the right to enforce such provision. The rights of The Design Ecademy Ltd under our Legal Terms shall survive the termination of our Legal Terms.
